CLIENT AGREEMENT

This Golden Goddess Agreement is Made Between

Coach, Heather Allison, Be In Love Services, The Golden Way LLC

and

You, the Coachee/Client ("You")

You and Heather Allison hereby agree to the following:

A Primordial Feminine and/or The School of Living Mysteries coaching program

You are entering into a group coaching program whereby Heather Allison will provide high level coaching to You over a 6 or 12 month period, depending upon the program entered: A. 12 months minimum for Golden Goddess, B. 6 months minimum for Lineage + Legacy, C. 12 months minimum for Solaria, D. 6 months minimum for SÓL). Sessions will be held as specified on the program or course page, and are approximately 90 minutes in duration. 

Private coaching programs are offered for a minimum of 4 months, and sessions will be approximately 45-60 minutes in duration, depending on the program details.

The duration of shorter programs, courses and classes is listed on their respective program pages, and there is no minimum amount of time for these. Payments will be required in advance of access to the coursework and content for these shorter programs, courses and classes, and Client will be removed from access, without warning, for lack of payment.

Limits on coaching calls: Heather Allison reserves the right to reschedule any coaching calls to accommodate holidays, health, travel and other needs as necessary. Heather Allison may occasionally skip or cancel a coaching call to accommodate holidays, travel, health, time off / vacation, and other needs as necessary, but will ensure that at least 33 coaching calls are offered each calendar year.

Supplemental support: Additional support will be provided via the members-only Facebook group, as needed. Coach will address Coachee questions to the best of the Coach's ability via writing. Coach will answer all reasonable posed questions to the best of her ability, as time and written format will allow. Coach will respond in a timely manner, generally within 48-72 hours if possible. Weekends, holidays, vacation, and extenuating circumstances may occasionally delay responses.

The cost of the programs are currently $599/month for Golden Goddess, $365/month for Lineage + Legacy, $277/month for Solaria, $127/month for SÓL, or the annual equivalent if paid in full by year. Early Bird and other Special Offer pricing may apply if offered during promotional periods. The cost is subject to change at any time, and may increase with each subsequent offering of the program. If you are paying in monthly installments you hereby agree to remit the monthly payments via preauthorized automatic electronic debit to your banking account or credit card, which will be charged every month, and continuing every month until payment is received in full. Payments are not refundable for any reason. Payments are due regardless of whether or not you fully and faithfully participate, or whether you complete the full program. 

The cost of shorter programs, courses and classes are as specified on their respective program pages. Cost of telephone calls: Unless otherwise agreed upon, You are responsible for initiating the call to any session, and You bear the cost of the telephone call. An audio Internet link is also available for clients who prefer this.

Terms

This agreement, will begin upon acceptance, and will continue for as long as services are procured. The requirement for the initial meeting is payment in full, or first payment according to the payment plan structure, for the selected Coaching Program, and the fee for the Coaching Program is payable via the Shopping Cart at www.primordialfeminine.com.

The services to be provided by the coach to the client are coaching or tele-coaching, as designed jointly with the client. Coaching, which is not advice, therapy or counseling, may address specific personal projects, business successes, or general conditions in the client's life, relationships, or profession.

Upon completion of the initial Coaching Program, coaching will convert to a month-by-month basis, or the Coachee may choose to re-enlist in a different Coaching Program.

Payment Plans

Payments are not refundable for any reason. All payments in the payment plans are due regardless of whether or not You fully and faithfully participate. You acknowledge that Heather Allison must receive my payment by the agreed upon date of each month or a $35 late fee will accrue every 30 days. If payment is not received within 30 days, You acknowledge that you may lose access to all downloadable materials without notice, will no longer receive coaching, and will still be accountable for making all payments through the end of this agreement. We may also terminate services if, in our sole opinion, You are conducting yourself or your business in a manner which is disparaging or disruptive to Heather Allison or infringes upon Golden Goddess, Be In Love Services, or The Golden Way LLC, or violates the confidentiality covenant stated above. In no event will any refunds will be issued. 

Cancellations and No Shows

By entering this program, you are Committing to pay the full amount of the program, even if you decide to leave. Entrance into this contract is a Commitment to fulfill it in its entirety, and contract is non-cancellable. If, under rare and extenuating circumstances, Coachee wishes to be released from the Golden Goddess, Lineage + Legacy, or Solaria contract before its completion, an additional payment of $1111 (or 50% of the balance owed, whichever is less) will be required for release. If paying the $1111 Contract Release Fee, you will receive access to either SÓL for a year or the Goddess course as a gift, but please note that a payment of $1111 (or 50% of the balance owed, whichever is less) is required for release from this contract. If there is financial hardship, an adjusted payment plan or arrangement can be agreed upon through conversation between Coach and Coachee.

Any private one-on-one sessions with Heather Allison, which may either be provided as Bonus support as a part of the program or purchased separately at special rate for clients, are non-refundable and non-transferrable. There is no penalty for sessions cancelled via email with more than 24 hour notice, or within reason during emergency situations. Heather Allison, Be In Love Services and The Golden Way LLC are under no obligation to refund or reschedule a coaching session if You fail to complete or appear for any or all of your private or group coaching sessions. In addition, all private coaching sessions included in the program must be used within 30 days of the date the program officially ends, or be forfeited, unless otherwise noted in writing via email or on a webpage during the course of the program.

Confidentiality

The Coach promises the Client that all information provided to the coach will be kept strictly confidential. Any client stories which are shared on blog, video, social media, telecourse or other medium for marketing or coaching purposes, or within a program or course for sale, will be pursuant to client approval and/or will be made anonymous and/or fictionalized to protect the identity of the client. Coach has the right to use case studies or examples of Client’s situations and results, any and all coaching reflections and channeled guidance shared with the Client during coaching conversations, and/or Client testimonials in future work but will never make reference to Client’s full identity, unless provided with written approval from the Client. I understand that the Coach requires the same confidentiality from all other members of the program, and that Heather Allison, Be In Love Services, and The Golden Way LLC is not responsible or liable for the compliance, or lack thereof, with this clause on the part of other members. 

The Coach reserves the right to record and/or photograph any session for review by a confidential certification committee for ongoing coach training and certification purposes only. The Coach reserves the right to use any photograph/video, without the expressed written permission of Client, however to ensure the privacy of Client, images will not be identified using full names or personal identifying information without written approval from Client, and no Session will ever be made public. If Client does not wish to have their session recorded for training purposes must make their wishes known to Company in writing, and this may require non-verbal and non-visual participation in the program.  

I understand that all sessions, both group or private, will be recorded via the Internet or telephone for my benefit, knowing that the use of technology is not always secure. I accept the risks of error, either technological or human, with regard to confidentiality of my information through the use of email, text, Facebook, posts at heather-allison.com, Skype and other uses of technology either by me or to me. I understand and accept the risks related to sharing personal information with the other members of the program and other paying clients of the same program, and I will not hold Heather Allison, Be In Love Services, or The Golden Way LLC liable or responsible for any information shared by other members outside of this group. I understand that recordings of these calls will be shared with the other members, other participants, and other paying clients of the same program. I understand that on occasion, recordings of both private and/or group sessions or classes may not be available due to technological or human error.

Defamation

Client hereby warrants, states, understands, contends and promises to not make any defamatory statements about Heather Allison, The Golden Way LLC, Be In Love Services, specific programs, and/or www.heather-allison.com or www.primordialfeminine.com, or any of their employees, agents, independent contractors, coaches or representatives, at any point, irrespective of whether Client is still in a coaching program or experience with The Golden Way LLC, and/or Heather Allison, has been in the past, or is no longer.

Coaching Relationship

Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional, or business goals and to develop and carry out a strategy/plan for achieving those goals.

A. Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. B. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease. C. Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility. D. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach. E. The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

Resale of Service and/or Intellectual Property

No sharing, resale, repurposing or distribution of services, products, content or intellectual property is permitted. Client agrees not to reproduce, duplicate, copy, sell, trade, resell, or exploit, for any commercial or personal purposes, any portion of the Service (including course materials & intellectual property), use of the Service, or access to the Service. 

You acknowledge and understand that the methods, processes and strategies taught in Golden Goddess constitute our Proprietary System which is confidential, and for which we claim copyright protection. We have spent considerable time and efforts in developing this Proprietary System, which includes all materials associated with the Golden Goddess, all coaching strategies taught, and all associated coaching advice. You agree to maintain the absolute confidence of our Golden Goddess program and our Proprietary System and agree not to duplicate, disseminate, distribute or otherwise disclose any part to any 3rd parties, for any reason, unless it is part of the Golden Goddess or unless required by legal process. You further acknowledge that the Proprietary System and the Program(s) are and shall remain the property of Heather Allison, Be In Love Services and The Golden Way LLC, and that you shall not infringe upon any part of the Proprietary System or Golden Goddess nor claim any part as your property, nor attempt to replicate or copy any part for your own competitive benefit. You further agree that your violation of this provision will cause substantial harm to Heather Allison, Be In Love Services, The Golden Way LLC and Golden Goddess, and for which we may seek all legal redress, which may include an injunction or substantial damages.

Limitation of Liability

While Heather Allison is absolutely convinced that you will derive great benefits from our programs and that You should become as connected with your Inner Goddess, your Soul, your Depth Wisdom, and your Highest Path as You envision, We of course cannot represent or guarantee that you will attain certain level of relationship, personal success, business success, intuitive ability, or emotional wellness as a result of our Coaching Program. As with any small business or career, each individual’s success depends on many factors, including your personal motivation, time commitment, how effectively you implement the strategies taught, and your efficiency in following up on each phase. The cost of this Program is an “investment” in yourself, and, as with any investment, there is both great potential for a great return on your investment, and a risk there is no return on this investment. We can guarantee, however that you WILL learn a lot of usable and translatable business strategies for success that, when followed by others, have achieved Life Changing results.

By using the Coach’s services, the Client accepts any and all risks, foreseeable or non foreseeable, arising from such transactions. All claims against the Coach must be lodged with the entity having jurisdiction within 100 days of the date of the first claim or otherwise be forfeited forever. Client agrees that the Coach will not be held liable for any damages of any kind, resulting or arising from, including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Service. Client agrees that use of this Service is at user's own risk. 

DISCLAIMER

I understand that I am working with Heather Allison for professional Life Coaching at the agreed fee. Professional coaching is distinctly different from counseling, psychotherapy or psychoanalysis and does not deal with the diagnosis or treatment of emotional problems. Since professional coaching does not constitute medical consultation or treatment, health insurance does not apply. These fees may be considered deductible business expenses.

Declaration

As Heather Allison, a life, relationship, spiritual, and spiritual entrepreneur consultant, the Coach will be making suggestions, giving homework, advising, taking the Client through exercises and meditations, and teaching the Client the communication and personal techniques developed by the Coach as well as those learned through her own teachers, mentors and coach training certifications. In addition to the co-active coaching aspects of working together, where the Coach may ask questions and walk alongside the Client on his/her journey, teaching and consulting also requires the Coach to lead and guide the Client, offer suggestions and solutions, and make recommendations for practices. The Client will always be asked to make decisions and take actions for themselves, however, and the Coach will never insist or require a Client to make decisions or take actions they do not wish to make. In the teaching and consulting capacity, the Coach will give information and instruction to the Client, as well as suggested practices. As an ordained (non-denominational) minister, the teaching and consulting from Heather Allison, therefore, is to be considered pastoral advice. The Coach is not a therapist, nor is Coach licensed by the State of Washington in any way. The decision to accept or decline information, instructions, guidance, suggestions, and teachings from the Coach is the Client's to make. 

These Coaching Programs are not intended to provide legal, financial or health-related advice. As the Client, I understand that Heather Allison, Be In Love Services, The Golden Way LLC and all programs offered fall under the category of Life Coaching, and I further I understand that life coaching is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education, sports and recreation. I acknowledge that deciding how to handle these issues and implement my choices is exclusively my responsibility.

As the Client, I understand and agree that I am fully responsible for my well-being during my group coaching sessions, including my choices and decisions. I am aware that I can choose to disregard any advice given during public or private sessions, whether from and intuitive, coaching, health, or business standpoint. I recognize that coaching, mentoring, and intuitive guidance is not psychotherapy and that professional referrals will be given if needed.

As the Client, I understand that Heather Allison and the programs offered do not treat mental disorders as defined in the DSM-V by the American Psychiatric Association. I understand that the advice and information given in the Program, whether written or spoken, is not a substitute for counseling, psychotherapy; psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of therapy. I agree that I am well adjusted, mentally health and ready to receive coaching and intuitive services. As the Client, I agree that if I am currently in therapy or otherwise under the care of a mental health professional, I have consulted with this person regarding the advisability of working with a life coach or spiritual teacher, or receiving intuitive advice, and that this person is aware of my decision to proceed with the life or spiritual coaching relationship.

By purchasing and entering into any coaching work with Heather Allison, and by participation in and viewing of the content on www.primordialfeminine.com, the Client hereby agrees to this disclaimer. Coachee should carefully read all information in the Terms of Use page at http://www.heatherallison.com/terms-of-use and the Privacy Policy at http://www.heather-allison.com/privacypolicy. 

By completing your purchase of coaching sessions and/or engaging in any form of coaching with Heather Allison, whether during free initial consultation session, paid session or email coaching, reading or engaging on the blog, viewing videos, or participating in or purchasing of any tele course, product, or electronic publication, you agree to all of these terms and release Heather Allison, Be In Love services, and the Golden Way, LLC from all responsibility and indemnity.
